AN ORDINANCE CLOSING AND VACATING PORTIONS OF HENRY AND SIXTH <br />STREETS. <br /> <br /> WHEREAS, the Portsmouth Redevelopment and Housing Authority made application <br />to close portions of Henry and Sixth Streets, as hereafter described; and <br /> <br /> WHEREAS, the Planning Commission, at a meeting held on September 5, 2000, <br />recommended approval of the closure and vacation of said portions of Henry and Sixth Streets <br />Avenue; and <br /> <br /> WHEREAS, notice of the proposed closure and vacation has been given the adjoining <br />property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia that Henry and Sixth Streets be closed and vacated as public streets and rights of way as <br />follows: <br /> <br /> HENRY STREET <br /> <br /> All that portion of Henry Street, lying situate in the City of Portsmouth, Virginia, lying <br />between the eastern right of way line of Seventh Street and the west right of way line of line of <br />Fifth Street. <br /> <br /> SIXTH STREET <br /> <br /> All that portion of Sixth Street, lying situate in the City of Portsmouth, Virginia, between <br />the south right of way line of Randolph Street and the south right of way line of Henry Street. <br /> <br /> BE IT FURTHER ORDAINED that a perpetual easement is hereby reserved unto the <br />City of Portsmouth in the portions of Henry and Sixth Streets hereby closed and vacated for the <br />installation, operation, maintenance and replacement of utilities owned and operated by the City <br />of Portsmouth and private utilities, which said easement may be released and vacated by the City <br />Manager as he may in his discretion deem appropriate, and in the best interest of the City of <br />Portsmouth. <br /> <br /> BE IT FURTHER ORDAINED that the City Manager is hereby authorized to make and <br />execute such deeds of conveyance or other documents as may be necessary and appropriate to <br />give effect to the vacation and closure implemented by this ordinance. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia at a meeting held on <br />September 12, 2000. <br /> <br /> Teste: <br /> <br /> <br /> City Clerk <br /> <br /> <br />
