AN ORDINANCE CLOSING AND VACATING A PORTION OF WILCOX STREET, AN UNDEVELOPED PAPER STREET LOCATED IMMEDIATELY TO THE WEST OF ST. MARK'S MISSIONARY BAPTIST CHURCH. WHEREAS, the Trustees of St. Mark's Missionary Church and the Portsmouth Humane Society have requested the closure of that portion of Wilcox Street located immediately to the west of St. Mark's Missionary Baptist Church, as hereafter described for single-family residential development of this area; and WHEREAS, the Planning Commission, at a meeting held on October 2, 2001, recommended approval of the closure and vacation of said portion of Wilcox Street; and WHEREAS, notice of the proposed closure and vacation has been given the adjoining property owners in accordance with Section 15.2-2006 of the Code of Virginia, as amended. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, Virginia that a portion of Wilcox Street be closed and vacated as a public street and right of way as follows: WILCOX STREET All that portion of Wilcox Street bounded on the north by Goodwin Towing and the Portsmouth Humane Society, on the east by Frederick Boulevard and a portion of the St. Mark's Missionary Baptist Church property, to the south by the remainder of the Sr. Mark's Missionary Baptist Church property and to the west by the City's Parks and Recreation ballfield. Applicant, St. Mark's Missionary Church shall pay to the City of Portsmouth the sum of Eight Thousand, Five Hundred Twenty-Two and no/I00 Dollars ($8,522.00) for this vacation and closure within sixty (60) days of adoption of this Ordinance; and this Ordinance shall become null and void if nor paid within the sixty (60) day specified time.
