AN ORDINANCE TO AMEND CHAPTER 37 OF THE CODE OF THE CITY OF <br />PORTSMOUTII, VIRGINIA (1988) BY AMENDING SECTIONS 37-44 (b), 37-73, <br />37-95, 37-132 and 37-250(b) THEREOF PERTAINING TO ADMINISTRATIVE <br />FEES IMPOSED ON TAXICABS AND TOW TRUCKS. <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That Sections 37-44 (b), 37-73, 37-95, 37-132 and 37-250(b) of the Code <br />of the City of Portsmouth. Virginia (1988) be amended and reordained to read as follows: <br /> <br />Sec. 37-44. Maintenance and inspections of public vehicles. <br /> <br /> (b) Vehicles acquired for use as taxicabs and other public vehicles shall be <br />inspected annually by the city, if they are no more than seven years old, nor have more <br />than one hundred thousand actual vehicle miles. Taxicabs and other public vehicles shall <br />be inspected every six months if they are more than seven years old or have more than <br />one hundred thousand actual vehicle miles. An inspection fee of $40.00 shall be paid <br />shall be charged for each annual or semi-armual inspection. Each vehicle shall be <br />inspected to ensure that it has current state inspection, city, and State Corporation <br />Commission decals. With respect to taxicabs, the vehicle shall also be inspected to ensure <br />that there is a working certified taximeter, that rates are conspicuously posted, and that <br />the exterior dome and meter flag lights are operational. No taxicab or other public vehicle <br />shall be placed into service or allowed to remain in service until any defect or violation <br />has been corrected. Upon correction of any defect or violation, the vehicle shall be <br />reinspected by the city prior to placing the vehicle into service. A reinspection fee of <br />$10.00 shall be charged for each reinspection until the vehicle is placed into service. <br /> <br />Sec. 37-73. Issuance or refusal; fee. <br /> <br /> If the chief of police shall determine that any applicant is of the age of eighteen <br />years or older, morally fit and having knowledge of the traffic laws of the state and city, <br />the chief of police, upon the applicant's payment ora fee of $20.00 shall issue to such <br />applicant a certificate of public convenience and necessity. If the chief of police is not <br />satisfied as to the qualifications and fitness of the apphcant to possess a public vehicle, he <br />or she shall refuse to issue such certificate. <br /> <br />Sec. 37-95. Issuance or refusal; fee. <br /> <br /> If the chief of police shall determine that any applicant is of the age of eighteen <br />years or older, not addicted to the use of intoxicating liquors or drags, morally fit and <br />having knowledge of the traffic laws of the state and city, the chief of police, upon the <br />applicant's payment of a fee of $20.00 shall issue to such applicant a public vehicle <br />driver's permit. If the chief of police is not satisfied as to the qualifications and fitness of <br />the applicant to operate a public vehicle, he or she shall refuse to issue such permit. <br /> <br />Sec. 37-132. Rates established. <br /> <br /> <br />
