AN ORDINANCE TO CLOSE A PORTION OF CAROLINA AVENUE. <br /> <br /> WHEREAS, the City of Portsmouth. Virginia, has made application to vacate, close and <br />discontinue the hereinafter described portion of Carolina Avenuel and it appearing that Notice of <br />Application and request for the Appointment of Viewers was duly posted September 8, 1978 on <br />the bulletin board of the City Hall Building of the City of Portsmouth, the bulletin board of the <br />General District Court, Civil Division, of the City of Portsmouth and the bulletin board of the <br />Circuit Court of the City of Portsmouth. <br /> <br /> WHEREAS, by Resolution of this Council adopted September 26, 1978, viewers were <br />appointed pursuant to Section 15.1-364, Code of Virginia, 1950, as amended, to view the <br />hereinafter described portion of Carolina Avenue and to report in writing whether in their <br />opinion any, and if any, what inconvenience would result from discontinuing said street; and <br /> <br /> WHEREAS, said viewers have reported in writing that in their opinion no inconvenience <br />would result from the closing and discontinuing of said street. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Portsmouth, <br />Virginia, that the hereinafter described portion of the specified street, which lies within the <br />proposed right of way of the proposed extension and interchange for Route 164, the same is <br />hereby closed and vacated as a public street: <br /> <br /> CAROLINA AVENUE - from the eastern right of way of <br />Industrial Avenue to the western right of way of HilI Avenue. <br /> <br /> BE IT FURTHER ORDAINED that the City of Portsmouth, Virginia hereby reserves <br />unto itself a perpetual easement, fight and pfivilege to install, operate, maintain and replace <br />water lines in said street from the eastern fight of way line of Industrial Avenue, eastwardly one <br />hundred (100') feet. <br /> <br /> BE IT FURTHER ORDAINED that the City Manager shall have authority to grant <br />such deeds as he may deem appropriate and necessary to convey said fights of said closed street <br />to such entity as may be required by the Commonwealth. <br /> <br /> Adopted by the Council of the City of Portsmonth, Virginia, at a meeting held on August <br />14, 2001. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
