from which it was removed as provided in this section. <br /> <br /> (d) Where the owner of the property has been assessed with costs of removal of <br />inoperative motor vehicle(s) as defined in this chapter there shall be a lien on the real <br />estate fi:om which said vehicle was removed, which lien and costs may collected as taxes <br />are collected. Where the owner of the vehicle is assessed the costs of removal, such <br />costs may be collected as taxes are collected. <br /> <br /> 2. That Section 23-26 of the Code of the City of Portsmouth, Virginia (1988) be <br />amended by amending subsection (a) and by enacting a new subsection (e) to read as <br />follows: <br /> <br />Sec. 23-26. Prohibition; declaration of nuisance; abatement generally. <br /> <br /> (a) It shall be unlawful and shall constitute a mfisance for the owner or occupant <br />of any land or lot in the city to permit any grass or weeds to grow upon such land or lot to <br />a height exceeding ten (10) inches within three hundred feet of any building or road or m <br />permit any debris to remain at any place upon such land or lot. <br /> <br /> (e) Any drug blight is hereby declared to be detrimental to the public health and <br />safety and a public nuisance and shall be removed from land, alleys, sidewalks and streets <br />or the activity causing the blighting influence discontinued whenever it'is necessary to do <br />so in order to effectively abate the nuisance. <br /> <br /> 3. That Chapter 23 of the Code of the City of Portsmouth. Virginia (1988) be <br />amended by enacting thereto new Section 23-10 and a new Article IV containing n32 <br />Sections 23-91 through 23-96 to read as follows: <br /> <br />Sec 23-10. Exemptions from the provisions of this Chapter <br /> <br /> To protect ecological sensitive areas the following properties are hereby exempt <br /> from the provisions of section 23-26(a) of this chapter. <br /> <br />1. Hoffier Creek Wildlife Preserve <br />2. All Tidal Wetlands areas as defined by City Codes <br />3. City owned and maintained parks and preserves <br /> <br />ARTICLE IV. REMOVAL OR REPAIR OF BUILDINGS OR OTHER <br />STRUCTURES HARBORING ILLEGAL DRUG ACTIVITY <br /> <br />Sec. 23-91. Affidavit and notice requirements. <br /> <br /> In addition to enforcement procedures established elsewhere, the city manager or <br />his designee is authorized to undertake corrective action with respect to drug blight on <br />real property in accordance with the procedures described herein. <br /> <br /> <br />
