ZONING AMENDMENT ORDINANCE Z-01-02 <br /> <br />BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Commercial C-2-K (Conditional), <br />the property desgribed in Petition for Zoning Amendment Number Z-01-02, is hereby <br />amended and changed so as to show said property zoned as Commercial C-2--K <br />(Conditional), and that said property is hereby zoned as Commercial C-2-K <br />(Conditional). <br /> <br /> 2. That the property affected by this ordinance by being zoned from <br />Commercial C-2-K (Conditional) to Commercial C-2-K (Conditional) is furthermore <br />described as follows: <br /> <br /> Z-01-02 <br /> <br /> Beginning at the southwest intersection of Frederick <br />Boulevard and Dahlia Street; thence, south along the <br />western right-of-way of Frederick Boulevard approximately <br />280' to a point; thence, northwest approximately 105' to a <br />point; thence, north approximately 302 ' to a point; thence, <br />east along the southern right-of-way of Dahlia Street <br />approximately 150' the point of beginning. <br /> <br /> 3. That the following condition, proffered by the applicant, Mark K. <br />Sisino, shall apply to the subject property: <br /> <br />(a) The use of the property shall be limited to auto repair, auto wholesaleing, <br />and auto retail sales. No auto body repair shall be permitted. <br /> <br />(b) The hours of operation shall be limited to 7:00 a.m. and 9:00 p.m., <br />Monday through Saturday, and 10:00 a.m. to 5:00 p.m. on Sunday. <br /> <br />(c) All vehicles for sale or repair shall be located within the fenced-in area of <br />the property after business hours. <br /> <br />(d) No vehicles awaitkng repair shall be stored on the site for more than thirty <br />consecutive days. <br /> <br />(e) Installation of screening shall meet the parking lot and landscaping <br />requirements as set out in Section 40-71.2 of the Zoning Ordinance. All <br />fencing and/or screening shall be properly maintained. <br /> <br /> <br />
