ZONING AMENDMENT ORDINANCE Z-01-02 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Commercial C-2-K (Conditional), the property desgribed in Petition for Zoning Amendment Number Z-01-02, is hereby amended and changed so as to show said property zoned as Commercial C-2--K (Conditional), and that said property is hereby zoned as Commercial C-2-K (Conditional). 2. That the property affected by this ordinance by being zoned from Commercial C-2-K (Conditional) to Commercial C-2-K (Conditional) is furthermore described as follows: Z-01-02 Beginning at the southwest intersection of Frederick Boulevard and Dahlia Street; thence, south along the western right-of-way of Frederick Boulevard approximately 280' to a point; thence, northwest approximately 105' to a point; thence, north approximately 302 ' to a point; thence, east along the southern right-of-way of Dahlia Street approximately 150' the point of beginning. 3. That the following condition, proffered by the applicant, Mark K. Sisino, shall apply to the subject property: (a) The use of the property shall be limited to auto repair, auto wholesaleing, and auto retail sales. No auto body repair shall be permitted. (b) The hours of operation shall be limited to 7:00 a.m. and 9:00 p.m., Monday through Saturday, and 10:00 a.m. to 5:00 p.m. on Sunday. (c) All vehicles for sale or repair shall be located within the fenced-in area of the property after business hours. (d) No vehicles awaitkng repair shall be stored on the site for more than thirty consecutive days. (e) Installation of screening shall meet the parking lot and landscaping requirements as set out in Section 40-71.2 of the Zoning Ordinance. All fencing and/or screening shall be properly maintained.
