ZONING AMENDMENT ORDINANCE Z-01-03 BE IT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Residential RS-75, the property described in Petition for Zoning Amendment Number Z-01-03, is hereby amended and changed so as to show said property zoned as Office Residential OR-75-K (Conditional), and that said property is hereby zoned as Office Residential OR-75-K (Conditional). 2. That the property affected by this ordinance by being zoned from Residential RS-75 to Office Residential OR-75-K (Conditional) is shown on Exhibit A, attached hereto and made a part hereof, and is furthermore described as follows: Z-Ol-03 Beginning at a point 241'+/- north of the northeast comer of the imersection of Portsmouth Boulevard and Bob White Road; thence, north 60'_+ to a point; thence, east 65'+ to a point; thence, north 44.5'+ to a point; thence, east 28.5'-+ to a point; thence, in a southerly direction 104.5'_+ to a point; thence, in a southeasterly direction 185'+ to a point; thence, west 45'+ to a point; thence, north 185'_+ to a point; thence, west 65'+_ to the point of the beginning. 3. That the following condition, proffered by the applicant, Holy Communion Lutheran Church, shall apply to the subject property: (a) The site shall be limited to a dental office and to church- related uses. The dental office use shall be permitted for a period not to exceed 24 months from the date of the rezoning. At the expiration of the 24 months, the site shall only be used for church-related activities. 4. That this ordinance shall take effect on the date of its adoption.
