ORDINANCE NO. 2001- 09 ZONING AMENDMENT ORDINANCE Z-01-01 BElT ORDAINED by the Council of the City of Portsmouth, Virginia: 1. That the portion of the zoning map attached to and made a part of the City of Portsmouth Zoning Ordinance which now zones as Residential RS-75, the property described in Petition for Zoning Amendment Number Z-01-01, is hereby amended and changed so as to show said property zoned as Residential RM-60-K (Conditional), and that said property is hereby zoned as Residential RM-60-K (Conditional). 2. That the property affected by this ordinance by being zoned from Residential RS-75 to Residential RM-60-K (Conditional) is shown on Exhibit A, attached hereto and made a part hereof, and is furthermore described as follows: Z-01-01 Beginning at the southeast intersection of Ann Street and Constitution Avenue; thence east along the south right of way line of Ann Street 155 feet, more or less, m a point; thence in a southerly direction 290 feet, more or less, to a point; thence in a westerly direction 205 feet, more or less, m a point on the east right of way line of Constitution Avenue; thence along the east right of way line of Constitution Avenue 270 feet, more or less, to the southeast intersection of Ann Street and Constitution Avenue, the point of beginmng. 3. That the following conditions, proffered by the applicant, shall apply m the subject property: (a) The residents will be restricted to persons age 62 years of age or older. Specifically, no children or other extended family ma.v live in the building. (b) A no parking zone will be established on Constitution Avenue and enforced by the City of Portsmouth. (c) The exterior recreation area will consist of a gazebo and landscaping on an open space area at the rear of the building. (d) All apartments will be a minimum of 750 square feet. (e) A minimum of twenty-seven (27) on-site parking spaces shall be provided. (f) The historic character of the structure will rem consistent with the Secretary of Interior's Standards for Rehabilitation.
