ORDINANCE NO. 2001- 09 <br /> <br />ZONING AMENDMENT ORDINANCE Z-01-01 <br /> <br />BElT ORDAINED by the Council of the City of Portsmouth, Virginia: <br /> <br /> 1. That the portion of the zoning map attached to and made a part of the City <br />of Portsmouth Zoning Ordinance which now zones as Residential RS-75, the property <br />described in Petition for Zoning Amendment Number Z-01-01, is hereby amended and <br />changed so as to show said property zoned as Residential RM-60-K (Conditional), and <br />that said property is hereby zoned as Residential RM-60-K (Conditional). <br /> <br /> 2. That the property affected by this ordinance by being zoned from <br />Residential RS-75 to Residential RM-60-K (Conditional) is shown on Exhibit A, attached <br />hereto and made a part hereof, and is furthermore described as follows: <br /> <br /> Z-01-01 <br /> <br /> Beginning at the southeast intersection of Ann <br />Street and Constitution Avenue; thence east along the south <br />right of way line of Ann Street 155 feet, more or less, m a <br />point; thence in a southerly direction 290 feet, more or less, <br />to a point; thence in a westerly direction 205 feet, more or <br />less, m a point on the east right of way line of Constitution <br />Avenue; thence along the east right of way line of <br />Constitution Avenue 270 feet, more or less, to the southeast <br />intersection of Ann Street and Constitution Avenue, the <br />point of beginmng. <br /> <br /> 3. That the following conditions, proffered by the applicant, shall <br />apply m the subject property: <br /> <br />(a) The residents will be restricted to persons age 62 years of age or older. <br />Specifically, no children or other extended family ma.v live in the building. <br /> <br />(b) A no parking zone will be established on Constitution Avenue and <br />enforced by the City of Portsmouth. <br /> <br />(c) The exterior recreation area will consist of a gazebo and landscaping on an <br />open space area at the rear of the building. <br /> <br />(d) All apartments will be a minimum of 750 square feet. <br /> <br />(e) A minimum of twenty-seven (27) on-site parking spaces shall be provided. <br /> <br />(f) The historic character of the structure will rem consistent with the <br /> Secretary of Interior's Standards for Rehabilitation. <br /> <br /> <br />
