UP-01-08 <br /> <br /> Beginning at point 774'+/- northwest of the intersection <br />of George Washington Highway and Victory Boulevard; <br />thence, west 173'+/- to a point; thence, south 226'+/- to a point; <br />thence, west 560'+/- to a point; thence, north 704'+/- to a point; <br />thence, east 630'+/- to a point; thence, south 226'+/- to a point; <br />thence, east 173'+/- to a point; thence, south 226'+/- to the point <br />of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br />(a) The hours of operation shall be limited to between 10:00 mm. and 1:00 <br /> a.m., Sunday through Wednesday, and I0:00 a.m. and 2:00 a.m., Thursday <br /> through Saturday. <br /> <br />(b) The applicant and any successor in interest shall comply with all <br /> applicable codes, ordinances, and regulations of federal, state and local <br /> governments and shall obtain and maintain in effect all necessary licenses <br /> and permits. <br /> <br />(c) All activities conducted on this'site shall be in compliance with the City of <br /> Portsmouth Noise Ordinance (City Code Section 24-255) and any <br /> amendments thereto. <br /> <br />(d) The applicant shall develop a plan to store, handle and remove trash and <br /> garbage at the site and shall submit the plan for approval to the Director of <br /> General Services. <br /> <br />(e) All taxes and fees in connection with the subject property and operation <br /> shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> ADOPTED by the CoUncil of the City of Portsmouth, Virginia, at meeting held on April <br />24, 2001. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
