100'+ to a point; thence, in a northerly direction 75'+ to a point of <br />the beginning, <br /> <br /> 3. That the use permit is approved subject to the following conditions which shall apply <br />to the applicant and any successor in interest: <br /> <br />(a) Occupancy shall not exceed six adult residents at any time.. <br /> <br />(b) Development shall be in accordance with the approved site plan and floor <br />plan, identified as Exhibits A and B, and made apart hereof. <br /> <br />(c) The facility shall provide and maintain three off-street parking spaces <br />meeting applicable codes. <br /> <br />(d) A furnished area for outdoor recreation shall be provided and maintained <br />at the rear of the property. <br /> <br />(e) A 10% tree canopy for the lot shall be provided and maintained. <br /> <br />(f) The applicant shall submit a plan for the handling, storage and removal of <br />trash for the site. The plan must be approved by the City Deparnnent of <br />General Services prior to commencement of operation of the facility. <br /> <br />(g) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local <br />govemmems and shall obtain and maintain in effect all necessary licenses <br />and permits. <br /> <br />(h) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> ADOPTED by the Council of the City of Portsmouth, Virginia, at meeting held on June <br />26, 2001. <br /> <br />Teste: <br /> <br />City Clerk <br /> <br /> <br />
