R-01-48 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED, OR DEEDS TO CONVEY PARCEL 2 ON THE PLAT ENTITLED "SUBDIVISION OF HARBOR CENTER SECTION ONE PORTSMOUTH, VIRGINIA" TO THE INDUSTRIAL DEVELOPMENT AUTHORITY OF THE, CITY OF PORTSMOUTH, VIRGINIA ALONG WITH THE "NORTH PIER" AND "SOUTH INLET" ON THE PLAT ENTITLED "PLAT SHOWING PROPERTY TO BE CONVEYED TO INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY OF PORTSMOUTH. VIRGINIA", AND EASEMENTS NECESSARY TO THE DEVELOPMENT OF THE SOUTH WATERFRONT. BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be,.and he hereby is, authorized to execute a deed. or deeds, from the City of Portsmouth, Virginia to the Industrial Development Authority of the City of Portsmouth, Virginia conveying the following property and interests therein, said properties and interests being necessary to the development of the South Waterfront, as follows: Parcel 1. The fee simple interest in all that certain lot, piece, or parcel of land, with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in the City of Portsmouth, Virginia, and designated as "PARCEL 2" on the plat entitled "SUBDIVISION OF HARBOR CENTER SECTION ONE PORTSMOUTH, VIRGINIA" Scale: 1" = 100', dated August 27, 2000, and duly recorded in the Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia in Map Book 18, at Pages 138-139. Parcel 2. The fee simple interest in all that certain lot, piece, or parcel of land, with the buildings and improvements thereon and the appurtenances thereunto belonging, lying situate and being in the City of Portsmouth, Virginia, and designated as "NORTH PIER" on that certain plat entitled: "PLAT SHOWING PROPERTY TO BE CONVEYED TO INDUSTRIAL DEVELOPMENT AUTHORITY OF THE CITY OF PORTSMOUTH, PORTSMOUTH, VIRGINIA", which said plat is to be dated and recorded in the Clerk's office of the Circuit Court of the City of Portsmouth, Virginia. The deed of conveyance for the property described as "North Pier" shall provide that the ''North Pier" or any part thereof, or any interest therein shall not be sold or conveyed in whole or in part, nor encumbered by easements or in any other manner, without the prior written consent of the City of Portsmouth, SAVE AND EXCEPT that the Authority may convey such easements and make such covenants with respect to said "North Pier" as it may be obligated to do by a Development Agreement with Ocean Marine, LLC, dated January 31, 2001.
