R-01-46 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />CONVEYANCE FROM THE CITY OF PORTSMOUTH TO THE COMMONWEALTH <br />OF VIRGINIA FOR TWO PARCELS OF PROPERTY IN PINNERS POINT AND A <br />CONSTRUCTION EASEMENT AND PERMANENT UTILITY EASEMENT. <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City <br />Manager be, and he hereby is, authorized to execute a deed of conveyance to the Commonwealth <br />of Virginia for the following described property, to-wit: <br /> <br />Parcel 081 - Being as shown on Sheet 7 of the plans for Route 164 State Highway <br />Project 0164-124-F04-RW-201 and beginning on the East (Right) side of Ramp F <br />Construction Centerline from the lands now or formerly belonging to the Commonwealth <br />of Virginia opposite approximate Station 35+30 to the existing South right of way line of <br />Marion Avenue opposite approximate Station 36+50, and containing 0.044 acre, more or <br />less, land, and being a part of the same land acquired by the Grantor from Pennie <br />Patterson, et vir, by deed dated 09/08/77 and recorded in Deed Book 713, Page 126, in <br />the office of the Clerk of the Circuit Court of the City of Portsmouth. <br /> <br />Parcel 084 - Being as shown on sheet 7-D of the plans for Route 164, State Highway <br />Project 0164~124-F04, RW 201 and beginning on the East (Right) side of Quebec Street <br />construction Centerline from the lands now or formerly belonging to Portsmouth Port & <br />Industrial Commission opposite approximate Station 11+25 to the land now or formerly <br />belonging to Portsmouth Port & Industrial Commission opposite approximate Station <br />11+85 and containing 0.059 acre, more or less, land, and being a part of the same land <br />acquired by the grantor from Louis Brenner. Special Receiver For Wool & Co., Inc. by <br />deed dated 04/06/78 and recorded in Deed Book 725, Page 781 in the office of the Clerk <br />of the Circuit Court of the City of Portsmouth. Parcels 081 and 084 together containing <br />0.103 acre. more or less, land. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager be, and he hereby is, authorized <br />to execute a deed of conveyance to the Commonwealth of Virginia for easements for possible <br />reconveyance, an easement for the construction, operation and maintenance of VA Power and <br />Commonwealth Gas facilities, together with all necessary attachments and appurtenances thereto <br />and together with the right of ingress and egress thereto over and upon the remaining lands of the <br />Grantor, along and upon the following described property, to-wit: <br /> <br />Being as shown outlined in YELLOW on the attached plat and lying on the East (Right) <br />side of and adjacent to the proposed East right of way and Limited Access line of the <br />aforesaid route from the lands now or formerly belonging to the Commonwealth of <br />Virginia opposite approximate Ramp F Construction centerline Station 35+34 to the <br />existing South right of way line of Marion Avenue opposite approximate Station 36+50. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute <br />such deeds, plats and other documents necessary to effect the conveyance of property herein <br />authorized between the City and the Commonwealth of Virginia as may be required, and to <br />require such deeds and documents to contain such other provisions as he may deem appropriate <br />and in the best interest of the City of Portsmouth. <br /> <br /> <br />
