R-01-45 A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF CONVEYANCE FROM THE CITY OF PORTSMOUTH TO THE COMMONWEALTH OF VIRGINIA CONVEYING TWO PARCELS OF PROPERTY AND TWO PERMANENT DRAINAGE EASEMENTS, A VIRGINIA POWER EASEMENT AND A PERMANENT DRAINAGE AND MITIGATION EASEMENT AND A TEMPORARY CONSTRUCTION EASEMENT ON THE PROPERTY KNOWN AS THE FORMER SEABOARD COAST LINE RAILRIGHT OF WAY AND ADJACENT TO THE OLIVE BRANCH CEMETERY TO THE COMMONWEALTH OF VIRGINIA (VDOT). BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City Manager be, and he hereby is, authorized to execute a deed of conveyance ro the Commonwealth of Virginia for the following described property, m-wit: Parcel 001 & 002 -Being as shown on Sheet No.'s 3, 4 and 5 of the plans for Clifford SWeet, State Highway Project U000-124-112, R/W-201 and beginmng on the south (right) side of Clifford Street construction centerline from a point on the lands of the Grantor the existing south right of way line of present Clifford Street opposite approximate Station 101+52 to a point in the lands of the Grantor opposite approximate Station 101+72 and containing 0.002 acre, or 7.68 square meters more or less land; and also beginning on the north (left) side of Clifford Street construction centerline from a point in the lands of the Grantor the existing north right of way line of present Clifford Street opposite approximate Station 100+01 to a point in the lands of the Grantor opposite approximate Station 101+58 and containing 0.418 acre, or 1,690.15 square meters more or less, land; together with the permanent right and easements to use the additional areas as being required for the proper construction and maintenance of drainage facilities (right) of approximate Station 101+11 to Station 101+15 and also from right of approximate Station 105+38 to opposite approximate Station 105+43, as indicated on plans said area together containing 0.010 acre, or 39.54 square meters, more or less, land; together with the permanent mitigation site (right) of approximate Station 105+04 to Station 105+33 as indicated on the plans and containing 0.172 acre, or 698.98 square meters, more or less, land; together with the temporary, right and easement to use the additional area shown as being required for the proper construction for cut and/or fill slopes and containing 0.435 acre or 1.759.55 square meters, more or less. Said temporary easement will terminate at such time as the construction of the aforesaid project is completed. Parcels 001 and 002 together contains 0.420 acre or 1,697.83 square meters, more or less. land. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute such deeds, plats and other documents necessary to effect the conveyance of property herein authorized between the City and the Commonwealth of Virginia as may be required, and to require such deeds and documents to contain such other provisions as he may deem appropriate and in the best interest of the City of Portsmouth, and
