R-01-45 <br /> <br />A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A DEED OF <br />CONVEYANCE FROM THE CITY OF PORTSMOUTH TO THE COMMONWEALTH <br />OF VIRGINIA CONVEYING TWO PARCELS OF PROPERTY AND TWO <br />PERMANENT DRAINAGE EASEMENTS, A VIRGINIA POWER EASEMENT AND A <br />PERMANENT DRAINAGE AND MITIGATION EASEMENT AND A TEMPORARY <br />CONSTRUCTION EASEMENT ON THE PROPERTY KNOWN AS THE FORMER <br />SEABOARD COAST LINE RAILRIGHT OF WAY AND ADJACENT TO THE OLIVE <br />BRANCH CEMETERY TO THE COMMONWEALTH OF VIRGINIA (VDOT). <br /> <br /> BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that the City <br />Manager be, and he hereby is, authorized to execute a deed of conveyance ro the Commonwealth <br />of Virginia for the following described property, m-wit: <br /> <br />Parcel 001 & 002 -Being as shown on Sheet No.'s 3, 4 and 5 of the plans for Clifford <br />SWeet, State Highway Project U000-124-112, R/W-201 and beginmng on the south <br />(right) side of Clifford Street construction centerline from a point on the lands of the <br />Grantor the existing south right of way line of present Clifford Street opposite <br />approximate Station 101+52 to a point in the lands of the Grantor opposite approximate <br />Station 101+72 and containing 0.002 acre, or 7.68 square meters more or less land; and <br />also beginning on the north (left) side of Clifford Street construction centerline from a <br />point in the lands of the Grantor the existing north right of way line of present Clifford <br />Street opposite approximate Station 100+01 to a point in the lands of the Grantor <br />opposite approximate Station 101+58 and containing 0.418 acre, or 1,690.15 square <br />meters more or less, land; together with the permanent right and easements to use the <br />additional areas as being required for the proper construction and maintenance of <br />drainage facilities (right) of approximate Station 101+11 to Station 101+15 and also from <br />right of approximate Station 105+38 to opposite approximate Station 105+43, as <br />indicated on plans said area together containing 0.010 acre, or 39.54 square meters, more <br />or less, land; together with the permanent mitigation site (right) of approximate Station <br />105+04 to Station 105+33 as indicated on the plans and containing 0.172 acre, or 698.98 <br />square meters, more or less, land; together with the temporary, right and easement to use <br />the additional area shown as being required for the proper construction for cut and/or fill <br />slopes and containing 0.435 acre or 1.759.55 square meters, more or less. Said temporary <br />easement will terminate at such time as the construction of the aforesaid project is <br />completed. Parcels 001 and 002 together contains 0.420 acre or 1,697.83 square meters, <br />more or less. land. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute <br />such deeds, plats and other documents necessary to effect the conveyance of property herein <br />authorized between the City and the Commonwealth of Virginia as may be required, and to <br />require such deeds and documents to contain such other provisions as he may deem appropriate <br />and in the best interest of the City of Portsmouth, and <br /> <br /> <br />
