That the use permit is approved subject to the following conditions: <br /> <br />(a) The occupancy of the childcare center may not exceed 201children at any one <br /> time. <br /> <br />(b) The age range of the children shall be from 2 ½ to twelve years of age. <br /> <br />(c) Hours of operation shall be limited to between 6:00 a.m. and 6:00 p.m., Monday <br /> through Friday. <br /> <br />(d) The outdoor play area shall be enclosed with fencing at least four feet in height. <br /> <br />(e) No more than thirty-one children shall occupy the outdoor play area at any one <br /> time. <br /> <br />(f) Outdoor play hours shall be limited to the hours between 8:00 a.m. and 6:00 p.m. <br /> <br />(g) The applicant shall maintain a minimum of forty-four on-site parking spaces for <br /> the childcare cemer. <br /> <br />(h) The center shall comply with the floor plan and site plan as submitted with the <br /> application. <br /> <br />(i) The center shall submit to all required inspections by the City's Fire Prevention <br /> Bureau, Public Health Department and Building Official and shall correct any <br /> code deficiencies noted during the inspections. <br /> <br />(j) The applicant shall comply with all applicable codes, ordinances, and regulations <br /> of federal, state and local governments and shall obtain and maintain all necessary <br /> licenses and permits. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council. <br /> <br /> <br /> <br />Adopted by the Council of the City of Portsmouth, Virginia, at meeting held on January <br />9, 2001. <br /> <br /> Teste: <br /> <br /> City Clerk <br /> <br /> <br />
